Through a quirk of Federation, retirement living is regulated by the New South Wales State government while Aged Care is regulated by the Federal government. It is essential to obtain proper legal advice before you enter a granny flat arrangement. However, if your Aged Care Assessment Team (ACAT) requires you to enter aged care, the Commonwealth Government will regulate your accommodation. The Aged Care Act and Aged Care Principles have been reformed and apply to any person entering an Aged Care Facility after 1 July 2014.
