Madeleine is a solicitor with some 28 years of experience and a partner of Elliot Tuthill Solicitors. Madeleine is one of only 69 Law Society Accredited Specialists (Wills & Estates) in the State of New South Wales (as at July 2022), and one of the only few practising in the Sutherland Shire.
Madeleine has enjoyed teaching at the College of Law and being a member of the Elder Law Succession & Capacity Committee of the Law Society of NSW.
Madeleine’s early career was with the Rural Bank of New South Wales which she believes instilled in her a careful and methodical approach to book-keeping and a complete knowledge of banking at branch level.
Madeleine left the bank to marry and to travel extensively to the United Kingdom and Europe. She has enjoyed skiing in many wonderful areas of the world. Her travels have created in her a great interest in other countries, languages and cultures and an understanding that all people have different capacities and different opportunities but remain entitled to be appreciated for their individual worth.
These past experiences assist Madeleine in a deep understanding of the administration of deceased estates and the diversity of needs in Will making, including international resolutions. Madeleine’s focus now is on complex estate administration and litigation involving will disputes and family provision claims.
STEP is a global professional body, comprising lawyers, accountants, trustees and other practitioners that help families plan for their futures.
STEP’s mission is to inspire confidence in families planning their assets across generations by setting and upholding high professional standards, informing public policy, promoting education, and connecting practitioners globally to share knowledge and best practice.
Full STEP members, known as TEPs, are internationally recognised as experts in their field, with proven qualifications and experience.
With her banking/bookkeeping background and her more recent legal studies, Madeleine understands the way in which accounting and law interact in the various areas of law in which she practises: family law, succession and estate law, trusts law, superannuation and commercial litigation.
Her career has involved her in the hearing and the appeal of commercial litigation matters. She has had many successes at Court with matters that involve claims upon estates, acting both for executors and for claimants.
Madeleine’s primary focus is to solve her clients’ legal problems quickly and without incurring too much pain and expense. This is not always possible, of course, but she finds great reward in helping her clients settle a matter with a sensible and fair approach. Many of Madeleine’s matters have finalised by her preparing documents that reach agreement by both sides rather than requiring mediation or the potentially expensive and stressful process of litigation.
Madeleine served as the Secretary to the St George Sutherland Law Society from 2009-2013 and Treasurer from 2014-2017. Through these roles, Madeleine liaised with many lawyers in the regions of St George and Sutherland Shire, various officers of the Law Society of New South Wales, Judges and Barristers.
